Morgan Smith’s practice focuses on insurance coverage and extra-contractual claims, complex personal injury, and construction defect law.  Morgan is licensed to practice in Washington and Oregon. She has participated in numerous arbitrations and trials of cases involving commercial, auto, and homeowners insurance coverage claims, motor vehicle accidents, insurance bad faith, the Washington Insurance Fair Conduct Act, and the Washington Consumer Protection Act.

Notable Results

Summary judgment dismissing all contractual and extra-contractual claims for water intrusion damage.

Summary Judgment dismissing legal malpractice claim, affirmed on appeal. Usoro v. Helm, 2011 WL 5043618 (2011).

Defended primary insurer in contribution action involving $6 million settlement. Trial court dismissed all claims on summary judgment. Bayley v. American Guarantee, et al., 2010 WL 4272454 (W.D. Wash. 2010).

Court of Appeals issued a favorable decision in Kim v. Allstate, 153 Wn. App. 339, 223 P.3d 1180 (2009) that reversed the trial court’s ruling.

Represented defendant insurer in reasonableness hearing of a $1.8 million consent judgment and subsequent construction defect insurance coverage trial. Trial court dismissed all extra-contractual claims and limited coverage to $255,000.
